No decision has been made on the proposal which is why we are asking for your views. Below provides you with details as to why we are thinking of Selective Licensing and what we would hope it will achieve for those living in the area.

We will continue to update the webpage during the consultation with further information (if required following any feedback) as well as upcoming events to allow you to let us have your thoughts on the proposal.

What is Selective Licensing?

Local authorities have powers to introduce Selective Licensing of privately rented homes to not only tackle poor housing but also wider issues in the area. Working in partnership with other organisations and service providers, Selective Licensing can help tackle such things as crime and antisocial behaviour as well as bringing support for residents eg. employment and training advice, help with budgeting and accessing services.  

Once an area is designated for Selective Licensing, every house that is let by a private landlord or agent within the footprint of the area needs a licence. There are some exemptions, for example houses that have a mandatory HMO licence. Local authorities charge a fee for the licence to cover the cost of administering the scheme and any scheme that is designated lasts for up to 5 years. 

The licences issued contain conditions which the licence holder has to meet during the period of any scheme. Those who fail to meet the conditions, or who rent properties without applying for a licence, would be committing a criminal offence which could result in legal action being taken against them. As part of the process properties would be visited by the council, to check that the conditions are being met and to offer additional support to residents. 

There are currently two Selective Licensing schemes in Beeston and Harehills, however, both come to an end on 5 January 2025.  

What Selective Licensing has delivered so far for Leeds

The private rented sector is an important housing provider for the citizens of Leeds. It has grown over the decades and has become more and more important at providing homes for families and individuals. It is a vital part of the housing offer in the city. 

However, not everyone in the city has a good quality home that is safe, warm and well managed. The aim of Selective Licensing is to ensure that all tenants enjoy this right. 

We have two Selective Licensing schemes currently in place, in Beeston and Harehills, which will come to an end on 5January 2025. This means there will be no Selective Licensing schemes in the city after that date. 

When these 2 areas were designated, the aim was to visit all the properties within the 5-year period. Unfortunately, this has not been achieved due to: 

  • in the main, the COVID-19 pandemic – this meant we were unable to start to visit homes until January 2022
  • COVID-19 delaying the recruitment of officers to support the schemes
  • given the restrictions relating to the pandemic, access to the offices and isolation requirements impeded the administration of licence applications
  • as part of the COVID-19 relief measures implemented by the council, we offered to delay the need for payment of licence fees until September 2020. A significant number of landlords took up the offer, which delayed the council’s ability to process and formally grant licences for a further 4-5 months. Inspections of said properties were also delayed as they could not take place until after the licences had been granted
  • unfortunately, a significant number of the properties inspected have not met the standards and required intervention by officers and works by landlords.

Despite the above delays, Selective Licensing has still helped to make a difference to people’s lives and the area in general by addressing housing conditions, providing support to residents and working with partners to address wider issues. 

Addressing poor housing conditions

Over 6,200 properties in Beeston and Harehills are licensed under the current Selective Licensing schemes. 

In their response to the consultation for the existing schemes, landlords and agents told us that 75% of properties were of a good standard and quality, while in fact this was far from the case. Inspections of properties in the two areas have found that 85% were not compliant, either with licence conditions and/or property standards, and required landlords to undertake work. This has meant it has taken longer to address the standards in the private rented sector within the current schemes in Beeston and Harehills than initially envisaged. It has required more detailed inspections and actions plus follow up visits and actions where necessary. 

During the life of the scheme, we have made over 4,500 visits to properties to improve homes. Whilst most landlords have undertaken the works required this is not always the case resulting in over 550 legal notices having to be served to get works done. 

So far over 1,500 homes have been improved because of Selective Licensing in Beeston and Harehills. Over 5,500 people have benefited from improvements to their homes as a result. 

Working with landlords we have been able to improve homes for those living there whilst also helping landlords to understand their responsibilities and what good property management looks like: 

Feedback from a landlord shows positive outcomes by supporting the sector, not just undertaking enforcement, are being achieved as well “Thanks for today and the way you conducted the re-inspection. It was fair and professional and encourages an effective working relationship between landlords and LCC. I am really proud of how the bathroom has turned out in Flat 1. I have already moved to get those two jobs completed asap. I have also spoke to the fire alarm company to address the issue of the orange light to stop the continuous ‘control enabled’ signal being on. Following your previous visit in October, I have been making steps towards improvements across another property and I think I can have my other property (3 self-contained flats) available for inspection soon. Thanks again”. 

A managing agent told us that they had changed the way they work, inspecting properties at least every 3 months to avoid them being used for criminality such as cannabis grows, removed landlords from their books who don’t undertake works and recognised that without Selective Licensing several of the landlords he looked after would not do the works he had requested. 

A concern raised by landlords in response to the previous consultation was that the council would not take legal action against landlords who failed to comply. In circumstances where landlords have not complied, the council have taken legal action. To date, 680 have been subject to investigation or continuing investigation up to June 24, resulting in 396 final civil penalties being imposed on landlords for failing to comply with licence conditions or failing to licence their properties so far. 

Supporting those who live in the areas

Traditionally people have not come forward to seek help with their properties and there has been a lack of action by some landlords and managing agents to repair their homes. By getting into licensed homes, we have been able to address poor housing conditions and landlords who have failed to provide good accommodation and support the wider needs of people we have visited. 

We have been able to help with over 1700 referrals to partners and worked with them to address a range of issues faced by different residents: 

  • An elderly gentleman living in poor conditions, with wastewater in the property, a blocked toilet and a kitchen which was not fit to use amongst wider issues came to the attention of the team. He also had no food or heating and was unable to pay his bills. There were real concerns about his wellbeing, the suitability of the accommodation, and his vulnerability with the potential issue of cuckooing as well. Working in partnership with LASBT and Adults and Health we were able to address his immediate issues by supplying a food parcel, we worked with the landlord to bring the home up to standard and ultimately worked with others to get him rehoused into more suitable accommodation. The property itself was then fully renovated and relet.
  • A young mother was discovered by the team who was struggling. Officers contacted Leeds Baby Bank and items were obtained for an expectant mother including a bath, a pushchair, a bed and nappies etc. Working with Housing Support we were able to get her moved to a more suitable home with a support network around her.
  • A family had been moved from another authority with no furniture. Working with Leeds and Moortown Furniture Store and Zarach, new beds, bedding, and nightwear together with bedroom furniture were obtained for a family who literally had mattresses in a bedroom that were shared.
  • A quote from a resident following a proactive visit to their home - ‘’I’ve lived here for 3 years and nothing had ever been done to the house. The bathroom and kitchen have always been in a poor state. I’ve never had any smoke alarms or fire doors. I’ve not even had handrails on the stairs which I find difficult to get up and down safely. Since the council have been involved, through Selective Licensing, they have made the landlord put all these things right and I am really happy with the result. I now love living in this house”.
  • Another tenant who received support because of officers visiting their property “I moved from Luton, Bedfordshire and I moved through the council due to me having issues with my husband. I got told that my house in Leeds was going to be a 4-bedroom but to my surprise it was a 3-bedroom, and the landlords turned the living room into a bedroom. They had put on the contract that it was a 4-bedroom and had charged me for 4-bedroom house. The house was in very poor condition, and I had told the landlord many times to try and do something and every time they would use the same excuse that the home was deep cleaned when it was clearly not. My daughter had slipped down the stairs once due to water coming through the roof when it had rained. We had told them, but they decided not to do anything about it. My landlords were absolutely awful to me. When you and your team told me you could help me, it meant so much I was so happy! You did so much for me and I can’t Thank You enough for everything you’ve have done for me. I will always remember you for everything you have done”.

Working with partners to address wider issues in the areas

As part of the partnership approach there have been a number of action days where the council, the Police, the Cleaner Neighbourhood Teams, the Locality Team, the Gypsy Roma Traveller Team and Leeds’ Antisocial Behaviour Team would look at issues affecting particular communities or streets in the areas. This involved visiting properties to undertake further inspections, together with visiting those which had been causing problems and visiting people who were in need to help them with issues such as their wellbeing, access to training, financial help etc. As part of the action days, we also brought the community bus for people to access services in their neighbourhood. 

In Harehills, as part of the Clear Hold Build partnership, we have supported the Police and others to address the issues in the area. The Clear Hold Build is an approach where partners work together to address serious crime affecting neighbourhoods and support the rebuilding of that community making it a safer place to live. As part of the ‘Clear’ stage officers attended properties following cannabis grows to pick up issues within the property and with the landlords and managing agents. We have also had conversations with a number of landlords regarding how best to avoid their homes becoming used by criminality moving forward, helping to reduce crime in the area. 

Unfortunately, despite Selective Licensing addressing several issues and helping people with their lives and homes there is still more work to do to make the areas a better place to live. 

Despite the ongoing inspections and work with landlords we are still finding too many poor quality homes in the city. In Beeston and Harehills we are still finding people living in homes which fail to meet the standards people deserve. 

Why continue with Selective Licensing?

The Leeds Best City Ambition sets out a mission to tackle poverty and inequality and improve quality of life for everyone in the city. 

Targeting improvements in housing quality will contribute directly to this mission and to the priorities which underpin it, shaped by the three pillars of health and wellbeing, inclusive growth and zero carbon. Improving housing quality and energy efficiency, and working with landlords to do so, is specifically highlighted as a priority for both health and wellbeing and zero carbon in the recently updated Best City Ambition, as well as in the Leeds Housing Strategy 2022-27. 

In addition, Leeds has recently declared itself as a Marmot City. Working with the University College London’s Institute of Health Equity (IHE) over the next two years, Leeds will look to tackle health inequalities focusing on giving every child the best start in life and creating healthy sustainable communities with good quality housing. The potential positive impact is especially relevant given any future Selective Licensing scheme would seek to benefit those living in some of the city’s lowest income communities with generally poorer quality housing stock and health outcomes. 

Why propose Selective Licensing in this part of Leeds?

The proposed area shows high levels of issues indicative of deprivation when compared to the rest of the city. The council and partners have identified the 5 wards as a priority to address issues as part of the Best City Ambition to tackle poverty and improve the quality of life for all. 

The following statistics illustrate why the council considers that there are high levels of deprivation in the area: 

  • Overall, 84% of the area is in the most deprived 10% in terms of the Index of Multiple Deprivation (IMD) ranking, compared to Leeds as a whole.
  • 57% of the area are not within employment compared to 17% of the city – this includes those who are unemployed, those with sickness, disability or caring responsibilities.
  • In terms of income 63% of the area is in the lowest 10% of earnings compared to 18% of the city as a whole.
  • 48% of households in the area are eligible for free school meals compared to 28% in the city as a whole.
  • Life expectancy in the area is lower for both male and females in the area. For females it 77.2 compared to 82 and for male it is 73.5 compared to 77 in the city as a whole.
  • All crime rate for reported crimes is higher per thousand population in the area with violence and sexual offences close to double, robbery more than double and drugs offences more than three times the Leeds rate.
  • Within the proposed Selective Licensing area outside of Beeston and Harehills, the council spends a disproportionate amount of time dealing with poorly managed and maintained homes when compared with other areas of the city. Excluding the existing Selective Licensing areas where there is proactive activity, 45% of all work to address standards in the private rented sector is in the rest of the proposed area, which contains 11% of the city’s population.

Alternatives to Selective Licensing

The council has considered alternatives to Selective Licensing to address the issues. 

In 2017 the council supported the launch of the Leeds Rental Standard, self-regulation of the sector supported by the National Residential Landlord Association and Unipol. This approach is considered insufficient to address the issues in the proposed area because there is limited engagement with the Leeds Rental Standard in the proposed area when compared with other areas of the city. 

Prior to the previous two schemes in Beeston and Harehills, the council adopted the Leeds Neighbourhood Approach to address area-based issues. Whilst it delivered improvements the approach dealt with issues street-by-street and so given the size of the proposed area and the scale of the issues identified in the existing Beeston and Harehills schemes, this approach would not address the level of issues facing people living in the area. 

Another alternative to Selective Licensing would be a reactive approach, responding to complaints raised in respect of property conditions in the area. The council does not consider this to be an effective method of addressing the conditions in the area because this relies on people coming to the council, understanding their right and not being in fear of eviction if they do complain. 

Whilst other options such as self-regulation, reacting to complaints, and smaller proactive geographical initiatives have been tried and have delivered results, they are not sufficient to address the wider issues in the priority wards as per the council’s Best Ambition for the Leeds. 

What do we hope to achieve by Selective Licensing in the proposed area?

The main aim is to improve the management and quality of people’s homes across the proposed area. Selective Licensing will mean all private homes will need a licence with conditions which landlords need to comply with, including issues around gas and electrical safety, ensuring they are kept well maintained, waste issues are addressed, and antisocial behaviour can be better tackled with partners. Officers will be able to proactively visit homes to ensure they are safe, warm, and secure for those living in their homes. 

It will also allow us to address those landlords who fail in providing good homes for people, by working with landlords to repair and maintain their homes. In the worst cases where landlords fail to comply, it will enable the Council to take legal action against them. 

By working in partnership, it will allow the council and others access into people’s homes and address wider issues around health, finance, employment etc as shown in the stories in 'What Selective Licensing has delivered so far for Leeds'. 

The partnership approach will also allow us to work closer with others to deal with wider community issues such as Clear Hold Build in Harehills, so helping to make the area better for everyone. 

Taking into account all of the above intended outcomes, the Council considers that Selective Licensing will contribute to a reduction of deprivation in the area. 

How much Selective Licensing would cost if agreed

As part of any scheme each property or unit of accommodation would require a licence which is subject to a fee. That fee would be paid in two parts. 

If you’re a member of the Leeds rental standard at the time of a licence application a discount of £150 per licence is available. 

It is proposed that the licence fee will be £1,100 if an application is made online and if made on paper it will be £1,225.

What this means for landlords

As a landlord you will be required to apply for a licence from the Council to rent out your home. The licence application fee is set out above. That licence has conditions which you will need to comply with. If you do not have a licence or fail to comply with the conditions, then you could be liable for prosecution or a civil penalty up to £30k.

The proposed conditions should Selective Licensing be approved are detailed below.

Proposed Selective Licensing conditions

Leeds City Council (‘the council’), being the Local Housing Authority, attaches the following conditions to the house subject to Selective Licensing by virtue of the provisions of Section 90 of the Housing Act 2004. 

The Licence Holder and (if appropriate) a person on whom restrictions or obligations under a licence are imposed, is required: 

Gas

1. To ensure that all gas installations and appliances are in a gas safe condition and that an annual gas safety check is carried out by a Gas Safe registered engineer. 

2. If gas is supplied to the licensed premises, the licence holder must produce annually to the council for their inspection, a gas safety certificate obtained in respect of the house within the last 12 months. 

3. To provide a copy of the current gas safety certificate to all tenants/occupiers at the beginning of their tenancy/occupancy and to keep a written record that this has been provided. 

Electrical Safety

4. To keep any electrical appliances that are made available in the house in a safe condition and to supply to the council, on demand, a declaration as to the safety of such appliances. 

5. To ensure that every electrical installation1 in the house is in proper working order and safe for continued use and to supply to the council on demand for inspection, a declaration as to the safety of such.

1“electrical installation” means fixed electrical cables or fixed electrical equipment located on the consumer's side of the electricity supply meter – s.2(1) Building Regulations 2010

Smoke Alarms

6. To ensure that a smoke alarm is installed on each storey of the house on which there is a room used wholly or partly as living accommodation and to keep each alarm in proper working order. 

7. To supply to the council, on demand, a declaration as to the condition and positioning of any smoke alarm. 

Carbon Monoxide (CO) Alarms

8. To ensure that a CO alarm is installed in any room that is used wholly or partly as living accommodation and contains a fixed combustion appliance other than a gas cooker and to keep any CO alarm in proper working order. 

9. To supply to the council, on demand, a declaration as to the condition and positioning of any CO alarm. 

Furniture and furnishings

10. To keep any furniture that is made available in the house in a safe condition and to supply to the council, on demand, a declaration as to the safety of such furniture. 

Antisocial Behaviour and Illegal Activity

11. To take all reasonable and practicable steps to prevent or reduce antisocial behaviour (ASB) by persons occupying or visiting the house, including, but not exclusively: 

  • i. To put in place a written procedure that indicates how complaints relating to ASB will be dealt with. A copy of the procedure must supplied to the occupier(s) upon the commencement of their tenancy and to the council on demand.
  • ii. To keep a written record of complaints received relating to ASB. The record must include details of the complaint together with the action taken to resolve the matter and must be retained for the term of this licence.
  • iii. Where ASB is sustained, regular or more than one occurrence (even if months apart), the licence holder take all reasonable and practicable steps to ensure it is effectively dealt with, up to and including eviction.

12. To take all reasonable and practicable steps to ensure that the property is not used and/or occupied in any manner which is contrary to the terms of the tenancy agreement and that no illegal activity occurs at the property. 

Management of the Property

13. To ensure that the internal structure of the house and every window and other means of ventilation is maintained in good repair and that any fixtures and fittings and appliances made available are maintained in good repair and working order. 

14. To ensure, as far as is reasonably practicable, that the exterior of the property (including any boundary walls, gates and yards) is maintained in reasonable decorative order and in a good state of repair; that the exterior is free from graffiti and fly posters and that gardens are maintained in a reasonably clean and tidy condition. 

Property Inspections

15. To undertake regular inspections of the property and to record the findings of these inspections and any follow up actions required and the date upon which such action was taken. 

16. To retain the inspection records, including details around any follow-up actions, for the period of the scheme. 

17. To supply to the council, on demand, a copy of any inspection records and follow-up actions taken for the period requested. 

Household Waste

18. To ensure that the house has suitable and sufficient provision for the storage and collection of waste arising from the household occupying the property, including the correct type and number of waste bins. 

19. To ensure that all waste collected from the premises complies with the council’s requirements for the disposal and recycling of waste from domestic premises. Details of the council’s requirements can be found at the council’s webpage: leeds.gov.uk/bins 

Tenancy Management

20. To supply to all the occupiers of the house, within 7 days of the commencement of any new tenancy, or within 7 days of the grant of a selective licence, a written statement of the terms on which they occupy the property and to keep a written record that this has been supplied. 

21. To supply to all the occupiers of the house, within 7 days of the commencement of any new tenancy, or within 7 days of the grant of a selective licence: 

  • i. contact details for the person managing the property (and/or another appropriate person(s))
  • ii. (if different from the above) emergency contact details to enable the tenant to report issues which occur outside of normal office hours

and to keep a written record that this has been supplied. 

22. To obtain a reference for each person who wishes to live in the house as their main home. References must be obtained before entering into any new tenancy, licence or other form of agreement to occupy the house and shall be retained for the term of this licence. 

23. To supply to the council, on demand, any references obtained for any tenancy, licence or other form of agreement to occupy the house for the term of the licence. 

24. To supply to the council, on demand, details of all occupiers of the house. 

25. Where a tenancy is terminated during the term of the licence, to ensure the correct process is followed and to supply to the council, on demand, a copy of all relevant documentation to demonstrate that the correct legal process has been followed. 

26. To ensure that the tenant/occupier is given at least 24 hours’ written notice of your intention to enter the house and specify the reason(s) entry is required. The exception to this is when it would not be reasonable to give such notice and access is urgent, for example in an emergency. 

Licence

27. To notify the council in writing, within 14 days, of any material change in circumstances that may affect the validity and/or terms of the licence, including: 

  • i. A change of address
  • ii. A change of manager, management arrangements or property ownership
  • iii. Any change in the licence holder’s and/or (if appropriate) a person on whom restrictions or obligations under the licence are imposed, or any associate’s circumstances that may affect their status as a fit and proper person under the Housing Act 2004
  • iv. Proposed changes to the house which would affect its status as a licensable property under Part 3 Housing Act 2004, for example if it becomes a licensable HMO under Part 2 Housing Act 2004.

Next steps

The consultation will continue until 13 December 2024. We will consider people’s views on the proposal and feedback on the issues raised.

We will then consider the proposal and decide if we will go ahead with Selective Licensing for the proposed areas or not.

If this does go ahead, it will not be in place until Autumn 2025.
