Notice of public path diversion order Leeds footpath no. 115

On 29 May 2024 Leeds City Council confirmed the above diversion order made under Section 119 of the Highways Act 1980. The effect of the Order as confirmed will divert Leeds Footpath No. 115 commencing from a point, SE 3774 3601, at the junction with Leeds Road, near the access to Scholes Park and proceeding for a distance of 40 meters to a point, SE 3775 3605, at the junction with the unaffected section of footpath to a new line running from a point, SE 3777 3602, at the junction with Leeds Road and the new access to Scholes Park and proceeding for a distance of 51 meters to a point, SE 3775 3605, at the junction with the unaffected section of footpath as shown on the Order Map.

A copy of the Order as confirmed and the Order Map may be seen at Parks and Countryside Reception, Farnley Hall, Hall Lane, Farnley, LS12 5HA (reference 181013), from 8am to 4pm on Monday to Thursday and 8am to 3:30pm on Friday and also at Scholes Library, Station Road, Leeds, LS15 4BJ during normal opening hours. Any person who wishes to claim compensation under Section 28 (as applied by section 121 (2) of the Highways Act 1980 (as amended by the Transport and Works Act 1992) of the 1980 Act for depreciation or damage for disturbance arising as a result of the coming into force of the Order must make a claim in writing addressed to the Chief Executive, Leeds City Council, Civic Hall, Calverley Street, Leeds, LS1 7UR, and serve it by delivering it at, or sending it by prepaid post to, that address not later than 3 December 2024.

Part 1 of the Diversion Order comes in to force on 26 June 2024 and Part 2 of the Diversion Order comes into force on 19 June 2024 but if any person aggrieved by the Order desires to question its validity or that of any provision contained in it on the ground that it is not within the powers of the Highways Act 1980, as amended, or on the ground that any requirement of the Act, as amended, or any regulation made under the Act has not been complied with in relation to the order, he or she may, under paragraph 2 of Schedule 2 to the Act as applied by paragraph 5 of Schedule 6 to the Act, within 6 weeks from 3 June 2024 may make an application to the High Court.

Notice of public path diversion order

This Order is made by Leeds City Council (‘the Authority’) under Section 119 of the Highways Act 1980 (‘the 1980 Act’) because it appears to the Authority that in the interests of the owner of the land crossed by the Footpath described in Part 1 of the Schedule to this Order it is expedient that the line of the path should be diverted.  

The Authority have consulted with every Local Authority whose area includes land to which the Order relates as required by Section 120(2) of the 1980 Act.  

By this order:  

  1. The public right of way over the land situated at Leeds Road, Scholes Park and shown by a bold continuous line on the map contained in this Order and described in Part 1 of the Schedule to this Order shall be stopped up after 28 days from the date of confirmation of this Order.
  2. There shall at the end of 21 days from the date of confirmation of this Order be a public Footpath over the land situate at Leeds Road, Scholes Park described in Part 2 of the Schedule and shown by a bold broken line on the Map contained in this Order.
  3. The rights conferred on the public under this Order shall be subject to the limitations and conditions set out in Part 3 of the Schedule

Schedule part 1 – Description of site of existing paths or ways

Leeds Footpath No. 115

Footpath commencing from a Point A, SE 3774 3601, at the junction with Leeds Road, near the access to Scholes Park, and proceeding for a distance of 40 metres in a northerly direction on an earth surface to a Point B, SE 3775 3605, at the junction with the unaffected section of footpath. The footpath has a width of 0.9 metres.  

Schedule part 2 – Description of site of new path or way

Leeds Footpath No. 115

Footpath commencing from a Point C, SE 3777 3602, at the junction with the new access to Scholes Park and proceeding for a distance of 51 metres in a northerly, then a north easterly, then a north westerly and finally a westerly direction on a crushed stone surface to a Point B, SE 3775 3605, at the junction the unaffected section of footpath. The footpath has a width of 2 metres and will only be fenced on one side.
