Vehicle Seizure notices

We may seize a vehicle if we have grounds to believe that it:

  • has been used in the commission of a fly-tipping offence
  • has been used to transport controlled waste without the appropriate registration

The Control of Waste (Dealing with Seized Property) (England and Wales) 2015 Regulations require us to publish a notice of seizure on our website when a vehicle is seized.

Notice of Seizure

The Control of Waste (Dealing with Seized Property) (England and Wales) Regulations 2015

Under the above legislation, Leeds City Council have seized a Ford Transit registration HL55 BUL.

The vehicle was seized on Tulip Road, South Leeds Retail Park on 21 February 2025 at 1:45pm because:

  • the driver was breaching their Duty of Care under s34 of the Environmental Protection Act 1990
  • the driver failed to comply with s1 of the Control of Pollution (Amendment) Act 1989

The vehicle was seized pursuant to s34B Environmental Protection Act 1990 as amended by The Control of Waste (Dealing with Seized Property) (England and Wales) Regulations 2015.

A person may make a claim of entitlement to the seized vehicle, within the period:

24/02/2025 and 14/03/2025

The evidence accompanying a claim must be sufficient to enable the seizure authority to make a determination of entitlement to the seized vehicle and therefore must include:

  1. Proof of I.D. – valid photo card driving licence or passport
  2. Proof of address (for example, two utility bills in the applicant’s name no older than 3 months)
  3. Vehicle Registration document for seized property
  4. Valid insurance showing named driver/s
  5. Written proof of authority to act as Agent IF acting in a representative capacity (for example, valid power of attorney plus items 3 – 4 above, and proof of ID and address of Agent)
  6. If transporting waste and / or collecting scrap metal, a valid waste carrier’s licence and a Leeds City Council scrap metal dealer’s licence
  7. Waste transfer Notes for the last two years of trading

The seized vehicle can be sold, destroyed, or otherwise disposed of in accordance with regulation 21 of The Control of Waste (Dealing with Seized Property) (England and Wales) Regulations 2015 if it is not claimed within the claim period; if a claimant who brought a claim within such period is not determined as entitled or if a duty to return arose but has ceased in accordance with regulations.

Claim a seized vehicle

A person may make a claim of entitlement to a seized vehicle within 15 working days of the date of the seizure.
